Mushidi Kambala Lisa Gender and Asylum Determination in South Africa


South Africa is the only African country with an asylum system where persecution on the grounds of gender is clearly recognised in the Refugee Act of 1998. However, it is unclear whether South African asylum determination officers are aware of that and to what extent this influences their decision-making. Similarly, it is unclear whether asylum seekers in South Africa know that there is a possibility of applying for refugee status on this basis. The study seeks to explore plausible explanations surrounding the issue. By using existing literature and semi-structural interviews with both asylum claimants and DHA officials, I found out that the lack of gender sensitivity from the DHA officials, lack of awareness and the difficulty to talk about their experiences from the side of asylum claimants are central to the problem.

To understand the policy environment within which refugees establish and operate their enterprises in South Africa’s informal sector, this report brings together two streams of policy analysis. The first concerns the changing refugee policies and the erosion of the progressive approach that characterized the immediate post-apartheid period. The second concerns the informal sector policy, which oscillates between tolerance and attempted destruction at national and municipal levels. While there have been longstanding tensions between foreign and South African informal sector operators, an overtly anti-foreign migrant sentiment has increasingly been expressed in official policy and practice.This report describes the strategies being used to turn South Africa into an undesirable destination for refugees, including the setting up of additional procedural, administrative and logistical hurdles; the undercutting of court judgments affirming the right of asylum-seekers and refugees to employment and self-employment; ensuring that protection is always temporary by making it extremely difficult for refugees to progress to permanent residence and eventual citizenship; and restricting opportunities to pursue a livelihood in the informal sector. Talkmore Chidede Legal Protection of Foreign Direct Investment. A Critical Assessment with Focus on South Africa and Zimbabwe


This study undertakes a critical assessment of the legal protection of foreign direct investments (FDI) in South Africa and Zimbabwe by determining their compliance with the international minimum standards, norms and/or best practices on the legal protection of FDI by host states. Firstly, the study argues that foreign investment is much needed in South Africa and Zimbabwe to improve economic growth and development, to create jobs, and to increase their competitiveness. However, these benefits are not accrued automatically but rather host states need to create an enabling environment to receive such benefits. Thus, host states need to put an investment scheme into operation to guarantee the legal protection of foreign investments. South Africa and Zimbabwe have at large crafted and implemented investment laws and related policies which tend to be hostile towards foreign investments. Therefore, similar investment laws and related policies in both jurisdictions are analysed. This study will also offer recommendations for a legal investment which is not only flexible, friendly, and favourable to foreign investment in South Africa and Zimbabwe but also advances their local economic policies.

Even though inequality is driven by many different factors, this paper attempts to analyze whether BEE was able to effectively reduce inequality in the way that it was intended. My findings suggest that BEE might have helped to reduce inequality between different races, but that it increased inequality among black people.During Apartheid, black people were excluded from major parts of South Africa's economy. This resulted in an unequal income distribution in South Africa. Even after Apartheid ended in 1994 income was distributed unequally between races. In order to reduce this inequality and equalize opportunities between the different races in South Africa, the government implemented an affirmative action program called Black Economic Empowerment (BEE) in 2003. In this case and in the following sections, the word "black" defines a racial group, including Africans, coloreds and Indians and can thus be used as synonym for "non-whites."
